PREAMBLE

      Believing that the right of those who toil to enjoy to the full extent the wealth created by their labor is a natural right, and realizing that under the changing industrial conditions incident to the enormous growth of syndicates and other aggregations of capital it is impossible for those who toil to obtain the full reward of their labor other than through united action; and recognizing the fact that those who toil should use their rights of citizenship intelligently, through organization founded upon the class struggle and acting along cooperative economic and political lines using the natural resources, means of production and distribution for the benefit of all the people, with the view of restoring the commonwealth to all those performing useful service to society;

 

      NOW, THEREFORE; We, the International Association of Machinists and Aerospace Workers, pledge ourselves to labor unitedly in behalf of the principles herein set forth, to perpetuate our Association on the basis of solidarity and justice, to expound its objects, to labor for the general adoption of its principles, to consistently endeavor to bring about a higher standard of living among the toiling masses.

ARTICLE 1

NAME OF ORGANIZATION

 

 

Section 1. This Organization shall be known as the Aeronautical Machinists Lodge No. 709, an affiliate of the International Association of Machinists and Aerospace Workers. This document shall be officially known as the Bylaws of said LL and it shall also be subordinate to the IAM Constitution.

 

Section 2. The cover sheet of the Bylaws for Local Lodge 709 shall contain only the name, address and emblem of said Organization.

 

ARTICLE 2

PLATFORM

 

Section 1. To bring within the Organization all classifications of work under the jurisdiction of the International Association of Machinists and Aerospace Workers in accordance with the IAM Constitution.

 

Section 2. To settle all disputes between employer and employees, not defined in this Constitution, when possible to do so.

 

Section 3. To shorten the hours of labor and discourage overtime, thus giving the members more opportunities for self-improvement and social enjoyment.

 

Section 4. To stimulate the political education of the members to understand their political rights and to use the ballot intelligently, to the end that the Government may be a government for, of and by the people, and not to be used as a tool to further ends of combinations of capital for its own glorification.

 

Section 5. We should support honest, sincere, qualified, progressive candidates for public office, who by their actions have demonstrated their support of the public interest and general welfare, objectives to which L.L. 709 is dedicated. In the making of endorsements, the capability, intelligence, unqualified integrity and the past record of the individual shall be employed as criteria for endorsement.

 

ARTICLE 3

ELIGIBILITY FOR MEMBERSHIP

 

Section 1. Any hourly employee at LMAS in Marietta and vicinity is eligible for membership in L.L. 709 provided they comply with the provisions set forth by Article I, Section 7 of the IAM Constitution.

 

Section 2. Each member in good standing of this L.L. has the right to nominate and vote, express opinions on all subjects before the L.L., to attend all membership meetings and express views, arguments and opinions on all matters and business, including candidates for office, properly before the meeting; to meet and assemble freely with other members, and generally to participate in the activities of the L.L. in a responsible manner consistent with good conscience in order to present and discuss factually and honestly the issues and personalities upon which the membership must base its decisions.  These rights shall at all times be subject to the rules of procedure governing meetings and other uniform rules and regulations contained in the Constitution, bylaws, and other official rules of the Grand Lodge and Local Lodge.

 

Section 3. A member in exercising the foregoing rights and privileges shall not take any irresponsible action which would tend to jeopardize or destroy or be detrimental to either the L.L. or the Grand Lodge as organizations, or their free democratic heritage; or which would interfere with the performances of this L.L. or the Grand Lodge of its legal or contractual obligations as a collective bargaining agent, or interfere with the legal or contractual obligations of this L.L. as an affiliate of the Grand Lodge.

 

Section 4. Violation or abuse of these rights and privileges of membership, or engaging in conduct prohibited by this Article, shall be conduct unbecoming a Union member and subject to charges and trial in accordance with applicable provisions of the IAM Constitution.

 

Section 5. The membership shall strive to obtain the objectives set forth in the IAM Constitution and additional objectives as established as the policy of the Grand Lodge, to maintain free relations with other affiliated bodies approved by Grand Lodge and to do all in its power to strengthen the Labor Movement.

 

ARTICLE 4

DUTIES AND RESPONSIBILITIES OF MEMBERS

 

Section 1. It is the duty of each member to have his dues book stamped up to date.

 

Section 2.

(a)   Members are expected to work harmoniously together and not try to gain credit by the discrediting of another member in any way. Falsification and causing detriment without cause to brother members shall be processed under the applicable provisions of the IAM Constitution.

 

(b) It shall be the duty of all members to assist the Shop Stewards and Committeemen or Business Representatives in carrying out the laws of the Organization.

 

(c) Members should present their dues book to the Shop Steward for inspection when requested to do so.

 

(d) Members shall read carefully the IAM Constitution and the LL Bylaws.

 

(e) No member of this LL shall make any agreement or settlement with his employer as to working conditions, hours, or pay, which shall be inconsistent with the collective bargaining agreement covering such working conditions, hours, or pay, and such member shall notify the union of any conference in which such settlement or agreement is the subject, and shall not participate in such settlement or agreement conference, unless and until the union has the opportunity to be present at any conference wherein such settlement or agreement is discussed.

 

(f) All visiting members shall be admitted by the Conductor-Sentinel after due examination and presented to the President, who shall refer them to special seats in the Lodge room.

 

(g) Any member involved in a strike, who leaves duties assigned to him in the course of the strike, without permission by the LL or the officers in charge, shall be guilty of conduct unbecoming a member.

 

(h) It shall be the duty of every member to notify the Secretary-Treasurer immediately of his change of address.

 

(i) It shall be the duty of all members to appear before the Executive Board if sent a registered letter bearing the proper signature and seal with time and place to appear within a reasonable length of time or furnish a reasonable excuse. In the event a member fails to appear after receiving a request for his appearance before the Executive Board, the subject matter of the appearance shall be processed by the Executive Board as if the member was there and appropriate action taken.

 

Section 3. Classification of Dues Books - All members shall be classified according to the definitions set forth in the IAM Constitution.

 

ARTICLE 5

NOMINATION AND ELECTION OF OFFICERS

 

Section 1.

(a) The officers of the LL shall consist of the following: President, Vice President, Secretary-Treasurer, Recording Secretary, Conductor-Sentinel and three (3) Trustees.

(b)  Sixty (60) days prior to an election, the President shall appoint at least three (3) Tellers to assist in conducting the election in a fair and impartial manner.

 

Section 2.

(a) Nominations for Local Lodge officers shall be held at the first meeting in November of election year. Officers of this Local Lodge shall be elected by secret ballot at the first meeting in December each three (3) years. Installation of officers shall be held at the first regular meeting in January following election.

 

(b) In election years, the first meeting in December shall be held on the first Wednesday for the purpose of holding elections. This meeting may be convened as early as 12:01 a.m. in order that all may have an opportunity to vote. Balloting shall cease at the close of the meeting.

 

Section 3. On election day in 1976, Local Lodge 709 will elect three (3) Trustees who will start their term of office January 1, 1977, along with the other officers and Business Representatives. The Trustees between them will elect a Chairman.

 

Section 4. An officer of the Local Lodge or Business Representative shall not be permitted to hold more than one (1) elected office, except that the President will be a full-time President and Business Representative, and the Vice President will be an Organizer and any officer or Business Representative may be elected as a delegate to a convention or affiliated body.

 

When necessary to hold a special election to fill a vacancy for an Officer's or Business Representative's position in Local Lodge 709, any elected Officer or Business Representative must resign by a letter to the Local Lodge 709 Recording Secretary no later than one (1) meeting prior to the opening of nominations if he desires to accept nomination; otherwise, he is disqualified.

 

When necessary, between general elections, due to a vacancy in the office of Conductor-Sentinel, or Trustee, there shall be nominations and elections to serve the remaining term of the vacated position by the following method. The membership shall be notified of nominations to be held for such vacancy on the circular announcing the next regular scheduled Lodge meeting. The election to be held on month later at the next regular scheduled Lodge meeting.

 

Section 5.

(a) The Recording Secretary of the Local Lodge shall mail a letter stating the time, date, place and location and hours of voting of the election to the last known address of each member in good standing not less than fifteen (15) days in advance of the election.

 

(b) In the event a tie vote occurs between candidates receiving the highest number of votes, a run-off election shall be held and only the candidates tied will be in the election. This run-off would not be held unless it was necessary to determine the persons who should take office.

 

(c) The candidate receiving the highest number of votes in any election shall be declared the winner. Where any office requires more than one (1) elected candidate, the number of candidates necessary to fill that office receiving the greatest number of ballots shall be declared elected. In the event of a run-off election, the 15-day notice to the membership shall apply.

 

(d) It is the constitutional responsibility of the Recording Secretary to prepare ballots. It is the responsibility of the Tellers to conduct the election, tabulate the votes and certify the results to the Recording Secretary. Should one (1) candidate for a given office request a recount, only that office will be recounted.

 

(e) Each candidate is entitled to have one (1) observer present at the polls and at the counting of the ballots. A candidate may not serve as his or her own observer or that of any other candidate.  In general elections, all candidates will be subject to the Local Lodge election rules and they must not congregate inside the Lodge hall.

 

(f) Voting recorders may be used in all general and special elections. The following procedure shall be followed: It shall be the duty of the Chairman of the committee to have printed ballots, cards and labels, whenever elections warrant the necessity of such. All ballots containing the names of two (2) or more candidates shall list their names on the ballot in alphabetical order.

 

(g) The Secretary-Treasurer will be present during the voting to furnish the Election Committee data regarding membership standing as a check-point for issuing ballots. In order to receive a ballot, a member must show his dues book or receive a clearance slip from the Financial Office. The Financial Office shall remain open during voting and counting of ballots. In the event a member is not on the checklist, he may vote a challenged ballot.

 

Section 6. Absentee Ballots shall be governed by applicable provisions of the IAM Constitution.

(a) When the Local Lodge uses voting machines, the same paper ballot which would be necessary to cast challenged votes may be used as absentee ballots. Immediately after the conclusion of voting, ballots shall be counted and tabulated.  Where voting machines are used, absentee ballots and challenged ballots shall be counted and added to the results obtained from the voting machines before the final count is announced. If voting machines are used, a certified list which is obtained from the Public Counter, which is a dial on the outside of the machine, which records the total votes cast, and the results must be properly recorded and certified by the Election Committee to the Recording Secretary.

 

(b) Even though a candidate is unopposed for office, his name must appear on the ballots. Ballots must be marked with an "X". Any identification or unusual markings on a ballot will cause the ballot to be void. If a member has voted for more or fewer candidates than are to be elected to an office, his vote for that particular office shall not be counted, but this does not affect the validity of the remainder of the ballot.

 

Section 7. Recount

(a) Any candidate may request a recount from the Election Committee. The Election Committee, in the exercise of sound judgment, based primarily upon the closeness of the vote and the number of ballots cast, may grant or deny recount. If the candidate who is requesting the recount is dissatisfied with the decision of the Election Committee, he has recourse by appealing to the LL meeting.

 

(b) In any election where the difference between the candidates requesting a recount and the candidate receiving the highest number of votes is less than one percent (1%) of the total votes cast for that office, the Election Committee automatically grants such a recount upon request. However, a candidate can request a recount, though the difference is more than one percent (1%). In recounting the ballots, the same general procedure in the original counting will be employed. For further appeals, the IAM Constitution applies. Should one (1) candidate for a given office request a recount, only that office will be recounted.

 

ARTICLE 6

DUTIES AND RESPONSIBILITIES OF OFFICERS

 

The officers of this Local Lodge, their selections with their duties and responsibilities shall be in accordance with the following sections:

 

Section 1. President

(a) The President shall preside at all meetings of the Local Lodge, decide all questions or disputes not covered by law, and sign all orders properly drawn upon the Secretary-Treasurer. He shall maintain order in the Local Lodge and cause the removal of disorderly members. He shall administer, or cause the obligation to be administered, to all new and reinstated members and perform such other duties as prescribed by the IAM Constitution and these bylaws. He shall appoint committees as authorized by these bylaws, or authorized by the Local Lodge. He may vote in any ballot vote, but in "voice" or "division" vote, he shall vote only to break a tie.

 

(b) The President shall exercise control of the Executive Office and maintain it on an efficient basis for rendering service to the members of the Local Lodge. The President shall employ and supervise all office personnel, other than those who report to the Secretary-Treasurer. Such right to employ and retain in his employment, office personnel whose salaries and other reimbursements are in excess of $300.00 per month, shall be subject to the approval of the Executive Board. The membership has the power to overrule the Executive Board's decisions. He shall review all proposed working rules and agreements to be negotiated by the Local Lodge. The President will be the spokesman for the Local Lodge in all negotiations with the Office Employees International Union, Local 2001. He shall work with and supervise the activities of the other B.R.s and will be empowered with authority to supervise and direct the B.R.'s in assignments, hours, vacations, and policing the contract, and any other duties that he feels are in the best interest of the Organization.

 

(c) He shall be Chairman of the Negotiating Committee of the union, and shall cause to be compiled statistical records of working hours, overtime, rules, wage rates, job descriptions, throughout the Aircraft and Missile Industry and make such available to the Senior Negotiating Committee and Classification Grievance Committee. He shall cause to be compiled information regarding the Social Security Act, Wage and Hour Laws and other laws or acts that affect organized labor on a Local, State or national level.

 

(d) It shall be the duty of the President to prefer charges against any B.R. who fails to comply with directives, assignments, or orders given to him by the President. He is also authorized to prefer charges against any member who fails to comply with the IAM Constitution and the bylaws of Local Lodge 709.

 

(e) The above charges shall be preferred in accordance with applicable provisions of the IAM Constitution.

 

(f) The President shall countersign all vouchers and checks properly drawn upon the Lodge funds. In the absence of the Secretary-Treasurer, due to sickness, vacation or other reasons, the Vice President shall countersign all vouchers and checks properly drawn upon Lodge funds.

 

(g) The President shall appoint a Local Lodge Communicator and a Local Lodge Educator, who shall serve at the discretion and direction of the President. The Local Lodge Communicator and Local Lodge Educator shall perform the duties set forth in Article 6, Section 7 and 8 respectively. The President shall make these appointments as soon as practical after his installation for a term to coincide with the elected officers of this Local Lodge. The President, at his discretion, can replace at any time the Local Lodge Communicator or the Local Lodge Educator.

 

Section 2. Vice President

(a) It shall be the duty of the Vice President to assist the President in preserving order and to preside at the LL meetings in the absence of the President. In case of death, removal or resignation of the President, the Vice President becomes the President until the next regular election.

 

(b) He shall be the Editor of the newspaper and will be a full-time Organizer.

 

(c) He shall perform any other duties assigned to him by the President of the LL as set forth in these bylaws.

 

(d) The Vice President shall carry out all of the duties of the President in the event of his absence due to sickness, vacation or other good cause necessitating his absence.

 

Section 3. Secretary-Treasurer

(a) It shall be the duty of the Secretary-Treasurer to receive all monies due this LL, to keep account of all receipts and disbursements, to make a monthly report of the financial standing of the LL and furnish the Editor of the union paper, "The Organizer", with copy of same to be published whereby all members can have a copy at the earliest opportunity. At the close of each 6-month period, he shall present his books, as outlined in the IAM Constitution, to the Auditing Committee to be audited. He shall pay all bills of the LL. He shall keep a true and accurate account of all monies received and expended by this LL. He shall furnish at each meeting a statement as to the total income and expenditure, assets and liabilities as of the last monthly report.

(b) He shall be authorized to sign checks. He shall be responsible for all personnel in his office, and shall be a working member of the Finance Office. He shall draw all checks from duly authorized vouchers and see to it that deposits in any one bank will not exceed the amount insured by a Federal Agency.

 

(c) He shall each month pay the per capita tax due the Grand Lodge and any other affiliated body.

 

(d) He shall perform any other duties spelled out in these bylaws.

 

(e) The Secretary-Treasurer shall supervise and direct the performance of duties of the clerical and office personnel assigned to him in carrying out his functions. With the Local Lodge's permission, he shall hire personnel authorized by the Local Lodge in carrying out the performance of his duties.

 

(f) It shall be the duty of the Secretary-Treasurer to notify the membership in attendance at the regular union meeting when a member ceases to be a Union member, and to notify the affected Shop Steward of same.

 

Section 4. Recording Secretary

(a) It shall be the duty of the Recording Secretary to keep a correct record of the proceedings of all meetings of the LL and to attest the same by signature and furnish the President and Secretary-Treasurer with copies of Local Lodge 709 minutes. He will conduct special correspondence as instructed by the Local Lodge and read all correspondence, communications and bills, turning the latter over to the Finance

Committee for their recommendations to the Local Lodge.

 

(b) He shall prepare and sign all credentials of delegates and alternate delegates to conventions of the Grand Lodge and forward duplicates thereof to the GST, and attest to same by properly signing and attaching the seal of the Local Lodge thereto.

 

(c) It shall be the duty of the Recording Secretary to maintain two (2) attendance books, one (1) for each section. He shall turn the books over to the Conductor-Sentinel at the start of each meeting and collect the books from the Conductor-Sentinel at the close of each meeting. At all other times, the attendance books are to be in the care of the Recording Secretary.

 

(d) Perform other such duties as are required by the I.A.M. Constitution.

 

Section 5. Conductor-Sentinel

(a) The Conductor-Sentinel shall examine all members' dues books prior to the opening of the LL, and report to the President all members present who are in arrears for dues.

 

(b) He shall assist in the initiation of candidates and see to the distribution of literature and perform such other duties as the President may require.

 

(c) The Conductor-Sentinel shall attend all alarms at the door, report same to the Vice President, and admit all members qualified to enter.

 

Section 6. Trustees: The duties of the Trustees shall be as follows:

(a) The Trustees shall be custodians of and exercise supervision over all the property of the LL, and keep an inventory thereof, and report same in writing to the LL, in their annual report at the first meeting in January.

 

(b) They shall manage and dispose of all property, invest all funds of this Local Lodge, when ordered to do by the Local Lodge, according to the IAM Constitution and these bylaws.

 

(c) They shall examine the books of the Secretary-Treasurer and assist in the auditing of the Local Lodge books by the Auditing Committee, attaching their signatures to the report of that committee.

 

(d) They shall transmit to the banks where this LL deposits its funds the names of the required officers.

(e) The Trustees of the Local Lodge shall be legally liable to the Executive Council of the Grand Lodge for all funds and other property of the LL under their control.

 

(f) It shall be the duty of the Trustees to check to see that any expenditure has been authorized by the membership before such expenditure is made.

 

Section 7. Communicator.

(a) The Local Lodge President shall appoint a Communicator who, in accordance with the official directives, policies, and programs of the Grand Lodge, will use the latest forms of information technology to communicate with the Local Lodge membership about their work and family lives.

 

(b) The Communicator may be a non-voting member of the Executive Board and will not be counted in the number required for a quorum or to call a special meeting of the Executive Board.

 

Section 8. Educator.

(a) The Local Lodge President shall appoint an Educator to assist in carrying out the official directives, policies, and programs of the Grand Lodge, and any other education and training programs approved by the Grand Lodge and related to educating and training the Local Lodge membership on all issues affecting workers and their families.

 

(b) The Educator may be a non-voting member of the Executive Board and will not be counted in the number required for a quorum or to call a special meeting of the Executive Board.

 

Section 9. All Officers, employees or other individuals in this Local Lodge who are responsible for, or handle funds of or for the Local Lodge, shall be bonded in accordance with the IAM Constitution and the IAM Policy relating thereto.

 

ARTICLE 7

SALARIES OF LOCAL LODGE OFFICERS AND REPRESENTATIVES

 

Section 1.

(a) For the faithful performance of their duties, the Officers of this LL and the Business Representatives and others shall receive the following salaries:

 

(b) President-Directing Business Representative's salary to be paid by Local Lodge 709 and the International to pay their share as set forth in the IAM Constitution. The monthly salary ($7,082.58, eff. 10/7/06) of the President shall be raised on the anniversaries of the Company-Union Agreement (10-3-81 and 10-2-82 and on). The President's weekly salary shall be raised by the same amount that the Labor Grade 18, Office and Technical employees receive (40 hour basis) on the above dates and on.

 

(c) Business Representative's salary to be paid by LL 709 and the International to pay their share as set forth in the IAM Constitution. The Business Representative's monthly salary ($5860.48, eff. 10/7/06) shall be raised on the same timetable and same amount as the President in the above paragraph.

 

(d). The Secretary-Treasurer shall receive a monthly salary of $5,860.48 per month, effective 10/7/06.

 

(e) The Vice President's salary to be paid by LL 709 and the International to pay their share as set forth in the IAM Constitution. The Vice President's monthly salary ($6112.31, eff. 10/7/06) shall be raised on the same timetable and same amount as the President's.

 

(f) Recording Secretary's salary to be $558.42 per month, effective 10/7/06. On each contract raise that Local Lodge 709 members receive, the Recording Secretary's salary will be increased per month in the amount what Labor Grade 18 Office and Technical receive per week on their contract raise. This will not include any cost of living raises or the folding in of any cost of living raises granted to Local Lodge 709 members.

 

(g) The President, Vice President, Secretary-Treasurer and each Business Representative shall receive $36.00 per week expenses, plus reimbursement of itemized and authorized expenses.

 

(h) The President, Vice President, Secretary-Treasurer, and each Business Representative shall receive a cost-of-living allowance in the same amount as the cost-of-living paid hourly bargaining unit employees under the Union-Company Agreement at the Lockheed-Georgia Company. (eff. 5/3/75)

 

(i) The cost-of-living allowance shall not be frozen in the base rate unless this is done as the result of contract negotiations. If this should occur, it shall be treated in the same manner as the cost-of-living for the hourly employees. However, any amount so treated will continue to be in addition to and exclusive of the provisions of Paragraph (a) of this section.

 

(j) Any cost-of-living allowances granted the President-Directing Business Representative and Business Representatives which exceed the maximum allowance of Grand Lodge contributions to the Business Agencies will be paid totally by the Local Lodge.

 

(k) In addition to the above-mentioned salaries, the union will give the President, Vice President, Secretary-Treasurer and each Business Representative the same vacation to which their seniority would entitle them with the company. This vacation can either be split or taken together.

 

(l) The time of vacations will be by mutual agreement with the President, preference being given by seniority. Each employee shall be required to take at least one (1) week of earned vacation during the twelve (12) months service time following the vacation eligibility date. An employee may accumulate all but one (1) week of vacation earned in an eligibility year, to a maximum of two (2) years accumulation. Pay for each week of accumulated vacation shall be based on the employee's base rate on the vacation eligibility date in which the accumulated vacation was earned.

 

(m) The Local Lodge shall carry, with a reputable company, life insurance policies comparable with those provided by companies our Local Lodge has contracts with. All full-time officers and Business Representative shall be covered by these policies.

 

(n) The Local Lodge shall carry public liability and property damage coverage for any liability to the Lodge which may result from injury caused by its officers or representatives or at its building.

 

(o) All full-time officers, Business Representatives or Organizers, at their own expense, shall carry an insurance policy with a reputable company, covering personal liability ($10,000.00 - $20,000.00) and property damage ($5,000.00) on any car he uses. The policies shall be inspected and approved quarterly by the Trustees.

 

(p) All Executive Board meetings will be held at the discretion of the Executive Board. Emergency deviations from this shall be determined by the Lodge President.

 

Section 2.

(a) All full time Officers and Business Representatives of LL 709 shall have an employee savings plan.

 

(b) The amount each Officer and Business Representative may contribute will be the same as members of LL 709 are allowed to contribute to their savings plan. The Local will match with half what is contributed by the Officers and Business Representatives.

 

(c) In case of the savings plan for members of LL 709 ever being converted to a percentage of salary, then all full time Officers and Business Representatives could contribute the same monetary amount as Labor Grade 18 Office and Technical.

 

(d). Withdrawals from this plan will be governed the same as members of LL 709 are on their savings plan.

 

ARTICLE 8

DUTIES AND RESPONSIBILITIES OF BUSINESS REPRESENTATIVES

 

Section 1.

(a) The qualifications for candidate for the position of Business Representative shall be as set forth in the IAM Constitution and Article 11 of these bylaws.

 

(b) No Business Representative is eligible to hold any other office in the gift of this Local Lodge, except that of President. A Business Representative is eligible to serve as a delegate to any affiliated body and to convention.

 

(c) The Lodge President is recognized as Directing Business Representative. He shall provide for 24-hour Business Representative coverage.

 

(d) There shall be a Business Representative for each 1200 Union members with a minimum of three (3) Business Representatives other than the Directing Business Representative. A maximum of 1200 retired members shall be counted for the purpose of this section.

 

(e) There shall be no reduction of any Business Representative under this section until the number of members countable under the above paragraph is five hundred (500) less than the number that would be required to recall him after he is removed from office.

 

(f) Reduce Business Representative's force by the number of votes. The Business Representative who received the smallest number of votes will be the first to go in case membership drops. A Business Representative who is elected in a special election will fall into the category of being the last one elected and would therefore be the first to go.

 

Section 2.

(a) Business Representatives will be elected at the same time officers of Local Lodge 709 are elected. They will be elected to serve for a term of three (3) years.

 

(b) Business Representatives shall assist the President in the performance of his duties when called upon, and shall be under the jurisdiction and powers of the President.

 

(c) The Business Representatives shall be under the supervision of the International President as outlined in the IAM Constitution, and they are subordinate to the President in all of their duties.

 

(d) In the case of a vacancy or opening in the position of Business Representative, the Executive Board shall meet immediately upon notification of said vacancy or opening. This temporary appointment shall be for not more than sixty (60) days. This paragraph applies only after all provisions of Section 1 (e) of this Article have been complied with.

 

(e) Priority in filling vacancies or openings in the position of

Business Representative shall be given to members who were removed from the position of

Business Representative in accordance with Section 1 (f) of this Article. The priority shall

be in effect only for the remaining portion of the term to which the Business Representative

was elected at the time of his removal. This priority shall be in the following order:

 

(1) Those who were elected in the general election shall be placed back on the basis of votes received. Those who received the most votes shall be placed first; the one who received the next most votes shall be placed next, etc.

 

(2) Those who were elected in special elections shall be placed in the order elected. The one elected in the first special election shall be placed first; the one elected in the next special election shall be placed next, etc. In the event more than one (1) Business Representative was elected in any one (1) special election, those who were elected in that election shall be placed back in order of votes received.

ARTICLE 9

ELECTION OF SHOP STEWARDS AND COMMITTEEMEN

 

Section 1. There shall be an annual Shop Stewards and Committeemen election; Stewards to be elected the first Thursday in February, committeemen to be elected the third Thursday in February, subject to the terms of any agreement reached between the union and the employer. A department with less than three (3) hourly employees will not elect a Shop Steward but will be represented by the Business Representative directly. No department with one (1) hourly employee will have a Shop Steward.

 

Section 2.

(a) There shall be an Election Committee of three (3) Tellers, usually agreed upon by all nominees. When necessary to have more than one (1) ballot box, there shall be an Election Committee for each balloting location.

 

(b) In the event two (2) or more departments merge, there shall be held a special election for the Shop Stewards involved within seven (7) calendar days. If one (1) of the Shop Stewards involved does not wish to run or fails to meet the requirements of Article 11, Section 3, the election will be opened for nominations department-wide. The tenure of service of such an elected Steward shall be considered as for an unexpired term and as expiring at the next regular election.

 

(c) The Shop Steward shall have the authority to determine the group and/or area which each committeeman shall represent. All committeemen elections will be voted on department-wide and each member who meets the requirements of Article 11, Section 3 are eligible to run for committeeman. In the event of a temporary absence of committeeman, the Steward shall have authority to appoint a temporary committeeman. If the Shop Steward is absent for a temporary period, the Business Representative will appoint a temporary Shop Steward. These appointments, however, shall not be for more than thirty (30) days and must meet the requirements of Article 11, Section 3. Should any vacancy occur, it will be filled immediately by the assigned Business Representative using the qualifications as set forth in Article 11, Section 3. An election shall be held within fifteen (15) calendar days. However, if a Shop Steward or Committeeman position becomes vacant and time is less than thirty (30) days of the annual Shop Steward or Committeemen election, then the Business Representative will appoint the Shop Steward or Committeeman, using the qualifications as set forth in Article 11, Section 3.

 

(d) A Shop Steward or committeeman will give up his position as Shop Steward or committeeman if he changes shifts.

 

(e) Beginning in 1998, and each year thereafter, Local Lodge 709 shall conduct a Shop Steward and Committee Person School. It shall be a requirement that all duly elected Shop Stewards and Committee Persons attend and complete all Educational Programs of the Local Lodge after being properly notified.

 

(f) The Election Committee's duties are to carry out the election in accordance with the Local Lodge bylaws and the IAM Constitution, and report to the officers, Business Representatives and membership the outcome of the election.

 

(g) Notice of Election: The Local Lodge President will furnish bulletins for the bulletin boards, giving at least three (3) days' notice for nominations and elections of both Shop Stewards and Committeemen.

 

(h) Secret Ballot: A check-off list and envelopes for challenged ballots will be furnished by the Local Lodge Secretary-Treasurer for each Steward and committeeman election. If a member's name if not on the check-off list, or if the member does not have a stamped dues book, he or she may vote a challenged ballot; such a challenged ballot shall be checked through the union's financial office.

 

(i) Each member shall sign his/her name and employee's number before receiving ballot.

 

(j) The Election Committee shall verify all challenged ballots before counting ballots. After the Election Committee has verified all challenged ballots, challenged ballots which have been verified shall be removed from the envelopes and put with other ballots.

 

(k) The balloting shall be by secret ballot, with the candidate receiving the greatest number of ballots to be declared elected. Each candidate may have one (1) observer at the scene of the voting and the counting of the ballots.

 

(l) In case of a tie vote, a run off election will be held the following Thursday.

 

(m) In case of two (2) consecutive tie votes for Shop Stewards or Committeemen, the candidates with the most IAM seniority will be declared winner.

 

(n) When electing more than one Steward or Committeeman in a department shift, you must vote for the specified amount of candidates. If a member has voted for more or fewer candidates than are to be elected to an office, his vote will not be counted.

 

Section 3.

(a) Appeals: Any union member of the department may, at the conclusion of the counting, challenge the election. The challenge shall be made to the Executive Board immediately after the final counting of the votes, in writing, setting forth the reason for the appeal. In no event will the challenge be considered if it is not made within five (5) working days of the close of the polls. The Executive Board will consider the challenge and make a recommendation to the next membership meeting where it must report the results of their decisions. The membership shall consider the challenge, and the Executive Board's recommendation and if convinced that the election was improperly conducted to such a degree as to invalidate it, may, by a majority vote, order a new election. If a new election is called for, the membership of the department affected will be notified by shop bulletin, and only those candidates who ran in the election will be eligible to run in the new election. The time will be noted on the shop bulletin board, and the new election shall be held no less than seven (7) days after the decision has been made by the Local Lodge.

 

ARTICLE 10

DUTIES AND RESPONSIBILITIES OF SHOP STEWARDS AND COMMITTEEMEN

 

Section 1.

(a) The members of this Lodge employed in any shop shall participate in the election of Shop Stewards and committeemen.

 

(b) All Shop Stewards and committeemen shall be governed by the bylaws of the Aeronautical Machinists Lodge 709 and the IAM Constitution.

 

Section 2. Members of this Lodge who are Shop Stewards and committeemen shall examine the dues books of members working under their jurisdiction and shall insist on members keeping themselves in good standing, and shall encourage membership in the International Association of Machinists and Aerospace Workers. Members of this Lodge who are Shop Stewards and committeemen shall report to the Business Representatives all infractions of this section.

 

ARTICLE 11

QUALIFICATIONS FOR ALL ELECTED AND APPOINTED POSITIONS

 

Section 1. Anyone serving in the capacity of delegate, Election tellers, Business Representative, officer or any elected or appointed position except Steward or Committeeman (see Section 3 for Steward and Committeeman and Election Tellers qualifications) must be working at the trade as that term is defined in the IAM Constitution, and must have at least two (2) years' membership in the International Association of Machinists and Aerospace Workers immediately preceding appointment and/or nomination.

 

Section 2. They must also have attended at least fifty percent (50%) of the regular Local Lodge meetings held during the 12-month period ending the date of the close of nominations.

 

(a) Any member requesting credit be given for an unattended L.L. meeting who is confined because of verified illness, or on vacation or on official I.A.M. business approved by the L.L., D.L., or G.L., or working for any employer on travel assignment or reserved military leave at the time of the L.L. meeting is held, be submitted to the Recording Secretary within the month for which the credit is requested.

 

Section 3.

(a) Candidates for Shop Steward and Committeeman must have at least one (1) year’s membership in the IAM immediately preceding nomination and have attended at least fifty percent (50%) of the regular Local Lodge 709's meetings held during the 12-month period ending the date of close of nominations. If no candidate has one (1) year's membership in the IAM immediately preceding nomination and fifty percent (50%) of Local Lodge 709's regular Union meetings as stated above, then there will be an open election.

 

(b) If a lead person desires to run for Shop Steward or Committeeman, they must resign from lead a minimum of one week prior to nominations being posted.

 

ARTICLE 12

TIME AND MEETING OF LOCAL LODGE NO. 709

 

Section 1. The regular meeting shall be held on the first Saturday at 10:00 a.m. of each month. If the first Saturday falls on a legal holiday, the following Saturday will be the meeting day.

 

Section 2.

(a) The President shall call special meetings in accordance with the IAM Constitution. The request shall set forth the precise nature of the business to be transacted, and no business other than that set forth in the notice of such called meeting shall be transacted.

 

1. No two (2) meetings may be called for the same day.

 

2. Notice of such meetings shall be issued at least forty-eight (48) hours prior to the meeting, except in the case of extreme emergencies when the Executive Board shall be the judge of the time limit.

 

Section 3.

(a) Fifty (50) members in good standing shall constitute a quorum. No business shall be transacted without a quorum, except in December during election year when the quorum will be reduced to twenty-five (25) members.

 

(b) At any time during a meeting any member calls for a count of the members present, and there is not a quorum, further business cannot be transacted and the meeting shall be immediately adjourned.

 

Section 4. Minutes will be kept of all official meetings.

 

ARTICLE 13

THE EXECUTIVE BOARD

Section 1.

(a) The Executive Board shall be composed of the officers of this Local Lodge. Their duties shall be to consider matters of business to be brought before this Local Lodge, to pass on same in the form of recommendations or objections, and to present same to the body for their approval or disapproval at the next regular meeting. In case of a division of judgment on any matter, a minority as well as majority report of recommendations may be submitted to the body. This Board's membership will serve only during their term of office.

 

(b) The Executive Board will meet prior to each regular Local Lodge meeting, and will keep minutes of same, and shall read them to the membership. A special called meeting of the Executive Board will be called when no less than six (6) members present a written request to the President.

 

(c) The quorum of the Executive Board shall be five (5), and if five (5) are not present, the meeting will be dismissed.

 

(d) The Executive Board shall have authority to introduce as recommendations to the membership issues or subjects that pertain to the good and welfare of the Organization.

 

ARTICLE 14

THE BYLAWS COMMITTEE

 

Section 1. The Bylaws Committee shall be composed of five (5) members. It shall be the duty of this committee to study all suggested changes and additions to said bylaws and make recommendations thereupon. This committee shall be appointed by the President at the first meeting in February and serve for two (2) years.

 

ARTICLE 15

COMMITTEES

 

Section 1.

(a) All committees provided for by the bylaws of LL 709 shall be elected and serve two (2) years, unless otherwise noted.

 

(b) All committees shall have the power to recommendation only. All decisions shall be brought to the Local Lodge membership for final approval.

 

Section 2. Senior Negotiating Committee:

(a) The Senior Negotiating Committee shall be composed of five (5) members in good standing, elected from the Local Lodge. One (1) of the above members shall be the President of the Local Lodge and Chairman of the committee.

 

(b) The Senior Negotiating Committee and Classification Grievance Committee shall be nominated in November and elected in December in the regular election for a term of three (3) years.

 

(c) This committee's duties and responsibilities shall be to hear grievances in the third step of the Grievance Procedure, to act on same, and to negotiate collective bargaining agreements. The Senior Negotiating Committee and Classification Grievance Committee will be briefed on all grievances prior to their meeting with the company.

 

(d) Alternates for the Senior Negotiating Committee: The next four (4) individuals receiving the highest number of votes during the election for the Senior Negotiating Committee will serve as the Alternate Committee. Replacements, if needed, would be added in order of votes received.

 

(e) If a member of the Senior Negotiating Committee should resign, retire, take a vacation or sick leave, or leave the Committee for any reason, an Alternate Committee Member in order of votes received during the election, would serve as the replacing Committee Member.

 

Section 3. Election Tellers

(a) The Tellers shall consist of at least three (3) members in good standing, appointed by the President sixty (60) days prior to an election, to assist in conducting the election in a fair and impartial manner.

 

(b) It shall be the duty of the Recording Secretary to notify the membership, by United States mail, at least sixty (60) days in advance of any election date of any officer.

 

(c) The Recording Secretary shall announce the results of the ballot as soon as possible, but not later than the first regular meeting, after the results of the election.

 

(d) 1.When elections for committees, delegates, etc. (other than general elections) are held on meeting days and the counting of the votes last two (2) hours or more, the members of the Election Committee will be paid $15.00 expenses.

 

2.When elections for strike votes or special elections are held, members of the Election Committee will be paid $25.00 expenses.

 

3.When the general elections are held, members of the Election Committee will be paid $25.00 per day for expenses for a maximum of two (2) days.

 

4.When elections for strike votes, contract votes, or special elections are held on days other than Monday through Friday, members of the Election Committee and Tellers will be paid $50.00 each.

 

Section 4. Classification Committee

(a)There shall be a minimum of three (3) members elected as a Classification Grievance Committee. This committee shall have authority to study classifications, and make settlement with the company in accordance with the terms of the contract.

 

(b) Beginning with the 1979 general election, the Classification Grievance Committee shall be nominated in November and elected in December in the regular election for a term of three (3) years.

 

(c) If a Classification Committee Member should resign, retire, or leave for any reason, the individual receiving the next highest vote total during the election, would be appointed as replacement. This order would follow until the vacancy is filled.

 

Section 5. Legislative Committee

(a) The Legislative Committee shall be appointed by the President annually at the first meeting in January. This will be a 3-man committee.

 

(b) It shall be their duty to watch all bills or measures in the City, State and Federal Legislative Bodies, affecting labor, and to bring same to the attention of the Local Lodge for consideration and to forward such information to "The Machinist".

 

(c) It shall be their duty to prepare such laws and ordinances for the benefit of organized labor as may be referred to them by the Local Lodge, submitting same to the Local Lodge for final action and, if adopted, they shall use every means to secure their enactment.

 

(d) It shall be the duty of the Legislative Committee to maintain a working relationship and close coordination with all IAM Lodges in Georgia and to establish and maintain liaison with other labor organizations in Georgia to promote cooperation in political and legislative matters of mutual interest to Local Lodge 709 members. The Legislative Committee, while in Atlanta for union business, shall receive $15.00 per day for expenses. They shall receive IRS standard rate per mile travel expense.

 

Section 6. Entertainment Committee

The Entertainment Committee shall be composed of five (5) members of this Local Lodge. Their duties shall be to make proper arrangements for various entertainments as the Local Lodge may direct.

 

Section 7. Sick and Relief Committee

The Sick and Relief Committee shall be composed of three (3) members who shall be appointed by the President, and of which he shall be the Chairman. Their duties shall be to call on any member who may be sick or in distress, and report same to the membership.

 

Section 8. Education and Organization Committee

The Education and Organization Committee shall be composed of three (3) members. Their duties shall be to present to the membership at regular meetings ideas on what constitutes a good union member, with special emphasis on the Preamble and Platform of our Constitution; to investigate and inform the membership of this Local Lodge on how to sell the idea of unionism to non-union fellow workers and to make the membership union label conscious in all their purchases wherever possible.

 

Section 9. Application Committee

An Application Committee shall be composed of three (3) members whose duties shall be to check all new applications and reinstatements, and to report their findings to the Local Lodge.

 

Section 10. Auditing Committee

An Auditing Committee of three (3) members shall be elected at the same time, and for the same term, as the Local Lodge Officers. This Lodge will audit the books semi-annually, at the close of June and December. The committee may, with the approval of the membership, engage a C.P.A. to assist in performing these audits. No officer of this Local Lodge shall be eligible to serve on this committee.

 

Section 11. Strike Committee

The Strike Committee shall be composed of the entire body of Shop Stewards and committeemen. The Chairman of the Stewards and committeemen shall act as leader, under the supervision of Local Lodge 709, with Shop Stewards and committeemen serving as Lieutenants. In this manner, the movements of every individual in the plant can be accounted for, and they could be placed in position in an orderly fashion where they would be most effective. The President shall appoint the Chairman of this committee.

 

Section 12. Finance Committee

(a) The Finance Committee shall be composed of the President, Secretary-Treasurer and three (3) Trustees. It shall be the duty of the Finance Committee to budget all funds and expenditures. An administration and operational budget shall be set up on an annual basis, subject to readjustment quarterly. Budgets shall be effective and in force immediately after approval of the Local Lodge. Three (3) members shall constitute a quorum.

 

(b) The Finance Committee shall place at least 84¢ per full dues paying member on the active payroll, per month in the budget for the preparation and the publishing of "The Organizer."

 

(c) No funds shall be spent that are not incorporated in the budget or approved by not less than three-fourths (3/4) of the members present and voting thereon.

 

Section 13. Public Relations and Political Education Committee

(a) This committee shall be composed of the Editor of "The Organizer" and all Shop Stewards. The duties of the Shop Stewards shall be to gather and report all news in the plant of interest that, in their judgment, will improve the morals and general welfare of this Local Lodge, to the Editor. The Editor shall compile these reports, and whatever news he can obtain from additional sources and, after editing, submit same to the publisher.

 

(b) The Editor will write as necessary, layout and edit the official newspaper of the Local Lodge "The Organizer". This paper will be distributed at least once every sixty (60) days.

 

(c) The Editor retains the right to edit or use a disclaimer on any letters or articles that do not reflect the official position of the Local Lodge. Letters or articles submitted for publication in the official newspaper of the Local Lodge must be signed by the members submitting them. If name is withheld from publication, then signed letter or articles must remain on file in the Local Lodge and available on request by any member.

 

(d) The committee shall encourage membership contributions for the Political arm for the support of these activities.

 

(e) This committee shall spend no Local Lodge funds without prior approval of the Local Lodge.

 

(f) Letters or articles appearing in the official newspaper of the Local Lodge must be signed by the member or members submitting said letters or articles for publication and printed in its entirety with a disclaimer that it is not the official position of the Local Lodge.

 

Section 14. The President shall have the right to fill temporary vacancies on all committees, except the Executive Board.

 

Section 15. The Women’s Committee shall be composed of interested members of the lodge. Beginning February 2000, a co-chairperson and secretary shall be elected at the February meeting of the Women’s Committee and shall serve for two years.

 

ARTICLE 16

DELEGATES

 

Section 1. Delegates to the IAM Convention shall be chosen pursuant to the provisions of the IAM Constitution.

 

Section 2. Any other delegates to any convention shall be elected at a regular meeting.

 

Section 3. It shall be the duty of the Recording Secretary to certify the Local Lodge's delegate to any affiliated body that this Local Lodge desires to send a Delegate.

 

Section 4.

(a) The President shall be a standing delegate to all conventions or conferences with the exception of the Grand Lodge Convention. A maximum of four (4) delegates to conventions or conferences will be elected by the Local Lodge, except for the Grand Lodge Convention. A maximum of four (4) delegates will be elected by the Local Lodge to attend the Grand Lodge Convention in accordance with the IAM Constitution, unless the President is elected then the maximum shall be five (5) delegates.

 

(b) If the President elects not to attend a function as delegate, the Vice President shall attend as his alternate. In the event the Vice President cannot attend, the President is authorized to designate an alternate to attend.

 

(c) Local Lodge 709 shall elect four (4) delegates to attend the Georgia State Council of Machinists State Convention. Should the President of the Georgia State Council of Machinists be a member of Local Lodge 709, he or she shall be a certified delegate of Local Lodge 709, receiving the same expense and consideration as the elected delegates.

 

(d) Should the Georgia State Council of Machinist Convention be held in conjunction with the AFL-CIO Convention, then the elected delegates to the Georgia State Council of Machinists will be certified delegates to attend both functions. The President and Area Vice President of the Georgia State Council of Machinist will also be a certified delegate to attend both functions, receiving the same expense and considerations as the elected delegates, providing he or she is a member of Local Lodge 709.

 

1. The elected delegates, along with the President and the Area Vice President of the Georgia State Council of Machinist, providing he or she is a member of Local Lodge 709, shall cast all votes for and on behalf of Local Lodge 709.

 

2. Should any member of Local Lodge 709 seek and obtain any office or position other than President or Area Vice President of the Georgia State Council of Machinist at these conventions, they will be released on Union business to attend at their own expense, if they so desire.

 

(e) Beginning in 2006, Local Lodge 709 may elect up to four (4) delegates to attend the annual IAM Women’s Conference and AFL-CIO Woman’s Conference when held in conjunction with IAM Women’s Conference.

.

Section 5. Local Lodge 709 will affiliate with the Georgia State Council of Machinists, and the Secretary-Treasurer will be charged with the responsibility of affiliation and paying per capita tax to the Council.

 

Section 6. a. All members conducting union business, including but not limited to delegates to conventions and conferences within the State of Georgia and not within a 35 mile radius of LL 709 shall receive actual lost wages and $50.00 per day for expenses to cover the cost of food, laundry and other essentials. Local Lodge 709 will pay single rate for lodging. Receipts for room cost must be submitted to LL 709. They shall receive IRS standard rate per mile travel expense. Taxi/Shuttle, and or parking will be reimbursed upon receipt. When conventions and conferences are held

within a 35 mile radius to LL 709, the expenses will be $15.00 per day and IRS standard rate per mile travel expenses. Effective 1-7-89, and thereafter, Senior Negotiating Committee members and Classification Grievance Committee members, while in meetings in Atlanta shall be treated as delegates to conferences under this section.

 

(b) All members conducting union business, including but not limited to, delegates to conventions and conferences outside of the State of Georgia and not within a 35 mile radius of LL 709 shall receive actual lost wages and $70.00 per day for expenses to cover the cost of food, laundry and other essentials. Local Lodge 709 will pay single rate for lodging. Receipts for room cost must be submitted to Local Lodge 709. They shall receive IRS standard rate per mile travel expense.

Taxi/Shuttle and/or parking will be reimbursed upon receipt. Delegates and representatives traveling to Union authorized functions which have travel reimbursements provisions specified in Local Lodge 709 bylaws who decide to drive shall receive the IRS standard mileage not to exceed full coach airfare.

 

ARTICLE 17

LOST TIME

 

Section 1. The Local Lodge shall pay a member lost time only when that member is performing necessary duties for and on behalf of the Local Lodge, during a time for which he would otherwise be compensated by the employer. The amount of lost time shall never exceed the amount which the member would otherwise have received from his employer for the same period of time for which he is being compensated by the Local Lodge, and the member shall submit an itemized statement of the expenses incurred to the Local Lodge before receiving payment.

 

Section 2. All lost time shall be approved by the Local Lodge, and the President may approve lost time between meetings when a condition exists that necessitates it; however, he must justify it at the next Local Lodge meeting. There shall be no premium paid for lost time work.

 

Section 3. The Local Lodge will keep an accurate record of all paid releases. This record shall be made available to the membership upon request.

 

ARTICLE 18

GENERAL RULES

 

Section 1. All Local Lodge officers, committees, Shop Stewards, committeemen and representatives and other members handling funds or other property of the Local Lodge shall at the completion of their duties, turn over all papers, documents, funds and/or Local Lodge property to the properly constituted Local Lodge officer.

 

Section 2. Whenever in these bylaws a pronoun is used, it refers equally, where the reference is applicable, to both men and women in the singular and in the plural.

 

Section 3. In case the Grand Lodge of the IAM changes their working rules by organizational approved practice, Local Lodge 709's working rules and bylaws will be automatically changed.

 

Section 4. Nothing in these bylaws shall be construed or applied in a manner that will conflict with the provisions of the IAM Constitution. All matters arising and not specifically covered by these bylaws shall be governed by the IAM Constitution.

 

Section 5. The IAM Constitution shall be the parliamentary guide at all meetings.

 

Section 6. Any member of this Local Lodge found guilty of conduct unbecoming a member of this Association may be suitably punished, including reprimand, suspension or expulsion, provided, however, that the Code of our Association has been complied with.

 

Section 7. No officer or member of this Local Lodge shall use the name or property of it for any purpose other than that designated by the IAM Constitution and these bylaws, unless by special authorization of the Local Lodge. Any violation of this section shall be punished as prescribed in the IAM Constitution.

 

Section 8. Any member of this Local Lodge who becomes an executive of a company or firm may not hold office, and any member becoming an executive of a company or firm must tender his resignation immediately as an officer.

 

Section 9.

(a) Should any doubt arise respecting the true meaning of these bylaws, it shall be referred to the International President of the Grand Lodge, who shall interpret their true meaning.

 

(b) Upon the adoption of these Bylaws, and approval by the International President of the Grand Lodge, beginning in 1981, once every three years a request for bids covering the printing of these Bylaws in booklet form shall be submitted to three (3) Union printers and the most economical bid shall receive the order. Beginning in 1981 the Local Lodge shall mail to every member's home a copy of said Bylaws once every three (3) years. In the intervening two (2) years, upon the adoption of these Bylaws and approval by the International President of the Grand Lodge, changes in these Bylaws shall be printed in leaflet form by Local Lodge 709. These leaflets will be made available by the Secretary-Treasurer's office for any member so desiring them. There shall be additional copies of the Bylaws and leaflets printed so that every new member of the Local Lodge shall receive a copy, after accepting him as a member in good standing.

 

(c) The President shall appoint a Chaplain and Parliamentarian.

 

(d) No commitments shall be made by any officer or representative for an expenditure of Lodge funds, unless such expenditure has been specifically authorized by the membership.

 

(e) It is a policy of this Lodge that no officer or Business Representative accept any gift from any candidate running for public office in a city, County, State or National election.

 

Section 10. It is the policy of this Lodge that no commercial advertising be allowed on union property.

 

ARTICLE 19

AMENDMENTS TO BYLAWS

 

Section 1.

(a) Any increase in the amount of initiation and reinstatement fees, Emergency Funds, and Local Lodge dues must be handled on the basis of the procedures specified in the IAM Constitution.

 

(b) Any other amendments to these bylaws must be handled on the basis of the following procedures:

1.   All proposals must be in writing, signed by not less than five (5) members, and referred to a Bylaws Committee appointed by the President not later than March 15.

 

2.   Must be read as proposed at two (2) consecutive meetings. Immediately following the second reading, the Bylaws Committee shall submit their recommendations.

 

3.   Reasonable advance notice must be given to the membership of the time, date and place of the second reading, and vote to be taken on the Bylaws Committee's recommendations.

 

4.   Each proposal must be considered and voted upon separately. A majority affirmative vote by those present and voting is needed for adoption.

 

5.   Triplicate copies of approved proposals, together with the master copy of bylaws shall be referred to the International President for approval and designation of an effective date.

 

Section 2. The Vice President of the Local Lodge shall have the bylaws printed as soon as possible. The amount of copies shall not exceed 2,000 over the current membership and once every three (3) years, the Secretary-Treasurer shall mail a copy to each member. When the bylaws are printed, the stated salaries paid to the officers and Business Representatives in Article 7 shall be the current salary paid at the time of printing.

 

ARTICLE 20

FUNDS

 

Section 1. All monies spent by this Local Lodge must be referred to the Trustees and must be approved by a majority of the membership present at a regular meeting.

 

Section 2. A Revolving Fund to be replenished the first Monday of each month, of approximately $200.00 shall be placed at the disposal of the Secretary-Treasurer for convenience.

 

Section 3. All Trustees and the Secretary-Treasurer must be present at a quarterly inspection of the contents of the safety deposit box. Exceptions can be made in emergencies only with the written permission of the absent Trustee and his signature presented to the Secretary-Treasurer. Under no circumstances shall this inspection be made with less than two (2) Trustees and the Secretary-Treasurer present while inspecting the contents of the safety deposit box for the purpose of seeing that all Local Lodge property is properly protected. All deeds, insurance policies, and valuable papers shall be kept in a safety deposit box in a local bank. This box shall be checked at each Lodge audit.

 

Section 4. No funds or property of this Lodge shall be loaned to any officer, representative or member of the Lodge.

 

Section 5. Local Lodge funds shall not be used to promote candidates for any elective office within City, County, State or National elections. (This will not preclude donations to the Educational Fund of MNPL.)

Section 6. Local Lodge 709's support to organized sports shall not exceed $2,000.00 per year. There shall be a maximum of $100.00 to any one (1) organization per year. All adult teams shall be 100% IAM members to receive any money from Local Lodge 709's organized Sports Fund. There shall be a limit of not more than two (2) requests from any dues paying member of Local Lodge 709.

 

Section 7. Contributions from Local Lodge 709 to labor unions on sanctioned strikes shall not exceed $100.00 per week for the period they are on sanctioned strike.

 

Section 8. Local Lodge 709 shall contribute 54¢ per month to the Retiree's Club 709 for each dues paying member of Local Lodge 709.

 

ARTICLE 21

INITIATION, REINSTATEMENT AND DUES

 

Section 1. This dues structure to go into effect the first day of the month following the election and installation of the first complement of officers and Business Representatives.

 

Section 2.

(a) The initiation fees, reinstatement fees and dues of this Local Lodge are as follows:

      Initiation Fee -- One month's dues

      Reinstatement Fee -- One month's dues

 

(b) The monthly dues of this Lodge shall be a uniform rate equal to two (2) times the weighted average hourly earnings of members covered by the collective bargaining agreement in each shop or bargaining unit under the Local Lodge jurisdiction in accordance with the IAM Constitution.

 

(c) An application for membership in this Local Lodge shall be made upon the usual blank form provided for such purpose, and when properly filled out and signed, shall be accompanied by the required fee, or dues deduction authorization card, and turned over to the Secretary-Treasurer, who shall give a proper receipt for same. The Secretary-Treasurer shall forward same to the Application Committee for approval.

 

(d) Any member in distress, through sickness, injury or on account of being out of employment, may receive out-of-work stamps for $2.00 per month, provided he has been out of work for the major part of a month. He must comply with the IAM Constitution.

 

(e) Seventy-five cents (75¢) per full dues paying member on the active payroll, per month, shall be deposited in a strike and Emergency Fund for Local Lodge 709's members only.

 

ARTICLE 22

LOCAL LODGE SEAL

 

Section 1.

(a) The Local Lodge shall procure a Seal from the General Secretary-Treasurer, which shall be made in accordance with the design adopted by the Grand Lodge. The seal shall be, and remain, in the custody of the Recording Secretary, and no paper, document, or communication issued by the Local Lodge shall be valid unless it bears the impression of said seal.

 

(b) A Special Seal, marked "Secretary-Treasurer's", shall be procured from the GST for the exclusive use of the Secretary-Treasurer in the performance of official duties.

 

Section 2. Illegal Use of Seal: Officers or members of the Local Lodge who use the seal for any purpose, without permission from the Local Lodge, shall be fined, suspended or expelled at the option of the Local Lodge.

 

ARTICLE 23

GRIEVANCES, STRIKES AND LOCKOUTS

 

Section 1. No strike benefits shall be paid to any member on strike, unless said strike is authorized by the Local Lodge. All applicable provisions of the IAM Constitution must have been complied with.

 

Section 2. Members who are on strike must be available for strike duty to receive strike benefits.

 

Section 3. The calling, conduct and termination of strikes shall, at all times, be carried on in compliance with the rules and policies prescribed by the IAM Constitution.

 

Section 4. Local Lodge Strike and Emergency Fund: The disbursements from this Fund shall be made by the Local Lodge at the time of any emergency or strike or by a special meeting.

 

Section 5. On any vote for a contract or for contract modifications, a secret ballot will be provided for the membership to accept or reject at the conclusion of negotiations, after due notice.

 

Section 6. Any voting for strike action or work stoppage in any form will be done by secret ballot.

 

ARTICLE 24

POWERS OF ADMINISTRATION

 

Section 1. The membership of Local Lodge 709 shall be empowered to take or direct any action consistent with the laws or policies of the IAM or bylaws of Local Lodge No. 709.

 

Section 2. Between Local Lodge membership meetings, the Executive Board shall be the highest authority of the Local Lodge and shall be empowered to act on behalf of the membership to the extent urgent business requires prompt and decisive action, subject to subsequent membership approval.

 

Section 3. Between meetings of the Executive Board, the President shall exercise general administrative authority and shall be empowered to act on behalf of the Executive Board, subject to subsequent approval of the Executive Board and/or the membership.

 

ARTICLE 25

EFFECTIVE DATE OF BYLAWS

 

Section 1. These bylaws shall take effect upon their adoption and approval of the International President and shall consummate the merger of Local Lodges 913, 1970 and 1996 constituting District 33, International Association of Machinists and Aerospace Workers, into one (1) Local Lodge, namely; Aeronautical Machinists Lodge 709, and Local Lodge 709 shall supersede and render void all names, documents, papers and properties of the above mentioned lodges, and become the official and responsible Lodge, assuming all debts and obligations, including the Building Corporation, and with the vested authority to officially execute all business transactions, including the payment of all debts and outstanding obligations to complete the merger.

 

Section 2. All properties and contracts and assets or other valuables, that now belong to District Lodge 33, and other mentioned lodges, shall become the property of Local Lodge 709.

 

Section 3. As a result of this merger, Local Lodge 615, in regular session, took action to function as a single local lodge because of Federal Law. Because of their affiliation with District Lodge 33, they will be entitled to free meeting space to carry on the transactions of their business.
